| Need | Official route | Core boundary |
|---|---|---|
| Public Nebraska criminal-history report | Nebraska State Patrol RAP request | Nebraska fingerprint-based arrests and resulting dispositions that are available for public release under state law. |
| Authorized national fingerprint check | Nebraska State Patrol fingerprinting | National fingerprint checks are available only when a state or federal law authorizes/requires the purpose. |
| Trial-court case and filed documents | Nebraska Judicial Branch JUSTICE case information | Court cases are a separate source; statewide trial-court search can show case summary, offense information, register of actions and many document images. |
State Patrol says the RAP sheet includes Nebraska arrests where the person was fingerprinted and the resulting dispositions.
The State Patrol explains that a known arrest may be absent if the person was not fingerprinted, if the arrest card was not submitted, or if the arrest occurred outside Nebraska.
Nebraska law requires certain criminal-history information to be excluded from the public view in specified circumstances. Public disclosure therefore is not identical to every record the repository may maintain.
The name-based request is searched using name and date of birth, with additional identifiers helpful for resolving potential matches.
Ask the employer, licensing board or agency whether a fingerprint-based national check is legally required and which authorization applies.
State Patrol fingerprinting guidance explains the collection route and states that nationwide fingerprint checks are only available for authorized state/federal-law purposes.
An authorized check may be released to the agency designated by the governing program, not simply treated as a public name-search product.
The public Nebraska RAP and an authorized national fingerprint check have different coverage and eligibility rules.
| Repository question | JUSTICE/court follow-up | Reason |
|---|---|---|
| What exact charge was filed? | Open the trial-court case and offense information | Repository labels can be summarized; the court file shows the filed case context |
| What happened after filing? | Review register of actions and disposition documents | Separates arrest from prosecution and final court result |
| Need a filed order | Use the available document image or the court that maintains the case | Court document is the better proof for exact legal language |
| No RAP entry but known case | Search the court case independently | State Patrol says non-fingerprinted or unsubmitted arrests may not appear in the RAP product |
The Nebraska State Patrol Criminal Identification Division maintains and updates the state repository and describes researching missing dispositions with courts/prosecutors. If the RAP contains an incorrect arrest/disposition, start with State Patrol instructions; if the underlying court filing itself is wrong, contact the court that maintains that case.
Label a public RAP as Nebraska criminal history; do not describe it as a nationwide search.
Remember that the repository is fingerprint-based even though the public request can be initiated with name/date-of-birth identifiers.
Do not infer that a public report contains every record the government may lawfully maintain.
Verify a consequential disposition at the trial court when exact outcome matters.
For employment or licensing, follow any additional statutory, FCRA or agency requirements rather than assuming the public RAP alone satisfies them.
